Important Notice
Effective January 1, 2010, disposal fees at all Yakima County facilities Will increase 14.28% from $27.03 per ton to $30.89 per ton. This will impact all garbage collection customers. The following table shows the current changes, the new charges, and the difference for various service levels (approximately 3%). Effective with the February 1, 2010 billing, the monthly charges for garbage service within the boundaries of the Yakama Indian Nation will be:.

The sum owing on the obligation secured by the Deed of Trust is: Principal $88,112.05, together with interest as provided in the note or other instrument secured from March 1, 2008 and such other costs and fees as are due under the note or other instrument secured, and as are provided by statute.

The above-described real property will be sold to satisfy the expense of sale and the obligation secured by said Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on February 12, 2010. The defaults referred to in paragraph III must be cured by February 1, 2010 (11 days before the sale) to cause a discontinuance of the sale. The sale will be discontinued and terminated if at any time on or before February 1, 2010 (11 days before the sale) the default(s) as set forth in paragraph III is/are cured and the Trustee's fees and costs are paid. by both first class and certified mail on January 22, 2009, proof of which is in the possession of the Trustee; and the Borrower and Grantor were personally served on January 23, 2009, with said written Notice of Default and/or the Notice of Default was posted in a conspicuous place on the real property described in paragraph I above, and the Trustee has in his possession proof of such service or posting.
VII.
The Trustee whose name and address is set forth below will provide in writing, to any person requesting it, a statement of all costs and fees due at any time prior to the sale.
VIII.
The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the above-described property.
IX.
Anyone having any objections to this sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections, if they bring a lawsuit to restrain the sale, pursuant to R.C.W. 61.24.130. Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee's Sale.

NOTICE TO OCCUPANTS OR TENANTS
The purchaser at the trustee's sale is entitled to possession of the property on the 20th day following the sale, as against the grantor under the deed of trust (owner) and anyone having an interest junior to the deed of trust, including occupants who are not tenants.  After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under chapter 59.12 RCW. For tenant-occupied property, the purchaser shall prove a tenant with written notice in accordance with RCW 61.24.060.

The Superior Court of Yakima County has directed the undersigned Sheriff of Yakima County to sell the property described below to satisfy a judgment in the above-entitled action. The property to be sold includes the real property, which is described as follows:

PARCEL B: All of Lot B and that portion of Lot “A” of Short Plat recorded in Volume “H” of Short Plats, Pages 37 and 38, records of Yakima County, Washington, described as follows: Beginning at the Southwest corner of Parcel “B” of said Short Plat; thence S. 2°53’05” W along the Westerly line of said Parcel “A” 98.12 feet; thence N 90°00’ E 150.44 feet to a line bearing S 0°00’ W from the Southeast corner of Parcel “B” of said Short Plat; thence N 0°00’ E 98.00 feet to the Southeast corner of said Parcel “B” thence N 99°00’ W 145.80 feet to the point of beginning.
PARCEL C: The NE ¼ of the NW ¼ of Section 23, Township 9 N, Range 22 E.W.M., Records of Yakima County, Washington EXCEPT road right of way along the North and East boundaries, and EXCEPT these portions conveyed by instrument No. 1552481. Yakima County Assessors Tax Parcel Numbers: 221026-41481, 221026-41480, 231031-22433, 220923-11001.
Commonly known as: 607 Lookout Dr., 1901 E. Lincoln Ave., and 1130 Green Valley Rd., Sunnyside, Washington.
The sale of the above-described property is to take place: 10:00 a.m., Friday, the 22nd of JANUARY, 2010, 2nd Street Entrance of the Yakima County Courthouse, 128 N. 2nd St., Yakima, Washington.
